INCIDENTS
93-743 - Canaveral (Florida) - Follow-up on Public Nudity Prosecutions
On November 19th, a district court magistrate filed an order which in
essence allows public nudity any place in the seashore. The magistrate
stated that he was bound by a state supreme court decision which states that
nudity must be accompanied by lewd and/or lascivious behavior to be illegal.
This order, which has serious implications for both the seashore and state
agencies, stemmed from a legal technicality which dictates that, when
assimilating a state law, the state's interpretation of that law must also
be assimilated - even though it may have been found in error by a higher

93-812 - Hawaii Volcanoes (Hawaii) - Follow-up on Death of Superintendent
A small, private memorial service for superintendent Hugo Huntzinger will be
held on November 27th, after which his cremated remains will be scattered
over Kilauea crater. A public gathering will be held thereafter for all
those wishing to remember him. [Scott Hinson, LES, HAVO, 11/23]
93-819 - Statue of Liberty (New York) - Bomb Threat
An unidentified woman called the park communication center just before noon
yesterday and told the dispatcher that the statue would be "blowing up."
When the dispatcher attempted to ask a question, the caller hung up. The
monument was searched, but no explosives were found. [Scott Pfeninger, CR,

93-820 - Cuyahoga Valley (Ohio) - Marijuana Cultivation Arrests
On the morning of November 23rd, rangers and local, county and state agents
executed a search warrant on a residence within the park which is occupied
under a retained use agreement that expires in 2001. Approximately 100
cultivated marijuana plants with a value of $200,000 were seized from the
residence along with equipment employed in indoor growing operations.
D.V., 40, and A.G., 48, were arrested on the premises.
D.V. has an extensive criminal history which includes assault on a
police officer, drug and weapons violations, and other crimes of violence.
The seizure and arrests marked the culmination of an extensive and lengthy
investigation by rangers and the Summit County sheriff's department. The

93-821 - Great Smokies (Tennessee/North Carolina) - Poaching
A three-day interagency stakeout operation involving four park rangers, five
Forest Service officers, and a North Carolina wildlife officer resulted in
the apprehension of four men in possession of four deer taken out of season
along Fontana Lake. The hunt occurred during the weekend of November 20th
on the Forest Service side of the lake, but there is a strong possibility
that more deer were shot in the park and left there. The joint
investigation is continuing. Items seized included four deer, two boats,
seven firearms and two radios. State and federal charges are pending.

93-822 - Blue Ridge (North Carolina/Virginia) - MVA with Fatality
Dr. J.C. was driving on the parkway early on the evening of November
19th when he lost control of his vehicle on Belcher Curve and ran off the
roadway. The vehicle overturned , skidded down the road, and struck a large
tree. His wife, H.M.C., was pronounced dead at the scene. Dr.
J.C. was taken to a local hospital. It is not clear whether either of the
C.s was wearing a seatbelt. [CRO, BLRI, 11/23]
93-823 - Nez Perce (Idaho) - Trespass; Resource Damage
On April 21st, park staff observed heavy equipment working adjacent to the
park boundary, and soon determined that approximately a third of an acre of
park land had been bulldozed. Trees, grass and shrubs had been pushed into
a large pile, concrete sidewalks associated with a historical site had been
damaged, and archeological lithics had been disturbed. Park and regional
personnel subsequently invested considerable effort in developing a solid
trespass and natural/cultural/archeological disturbance case, which the U.S.
attorney's office brought to federal magistrate's court in Moscow, Idaho.
On November 17th, the magistrate dismissed the case on the grounds that the
government had not established the identity of the defendant in the
courtroom - a basic rule of courtroom law and an inadvertent mistake by the

93-824 - San Juan (Puerto Rico) - Special Event
A number of events took place throughout the city of San Juan on November
20th to commemorate the 500th anniversary of the discovery of Puerto Rico.
The park hosted a symphonic and ballet ensemble of over 400 artists and
musicians who performed the "1812 Overture", complete with live cannon
salutes and fireworks. The event was managed by park personnel and
Explorers from the park's new Explorer's post. No unusual incidents were
