INTERAGENCY AGREEMENT

BURNS DISTRICT

Article I. Background and Objectives

WHEREAS in the John Day region of Eastern Oregon there occurs a series of geologic formations with paleontological resources of national and international significance.

WHEREAS the National Park Service (NPS) and the Bureau of Land Management (BLM), both agencies of the Department of Interior, manage lands with exposures containing these formations.

WHEREAS there is a need for the proper management, including inventory, field recovery, identification, stabilization, preparation, and cataloging, of these resources.

WHEREAS there is an obligation for the proper accountability for scientific specimens collected from the public lands.

WHEREAS the ability of both agencies to manage these resource will be enhanced by gathering and sharing information provided by ongoing and future research efforts.

WHEREAS the NPS and BLM have entered into a national level Memorandum of Understanding for Planning and Program Coordination (January 29, 1987), which encourages mutual cooperative resource management efforts.

WHEREAS the BLM in Oregon/Washington has a paleontological program policy which encourages the agency to seek opportunities for management agreements (IM-OR-87-85).

WHEREAS the expertise and facilities required for the appropriate conservation of these resources exists at John Day Fossil Beds National Monument.

WHEREAS the NPS and BLM may enter into agreement as authorized by the Economy Act of 1932, P.L. 97-332, and other authorities.

Article II. Statement of Work

The National Park Services agrees to:

A. Provide technical expertise in the management of paleontological resources occurring on BLM lands in the John Day region.

1. Assist with paleontological surveys.
2. Assist in de terming significance of fossil localities and specimens.
3. Supply taxonomic and osteological identifications of paleontological material.

B. Provide curatorial facilities and accountable storage of retrieved paleontological specimens.

1. Specimens must be compatible with the John Day Fossil Beds National Monument's Scope of Collections statement.
2. Specimens stored in the NPS museum collection will receive NPS catalog numbers.

C. Provide facilities and materials as available, for paleontological related work such as library research, fossil preparation, computer records and aerial photography.

The Bureau of Land Management agrees to:

A. Consult with the NPS on activities or actions which could potentially affect paleontological resources (e.g., land use plans, activity plans, research proposals).

B. Provide the support and logistical assistance necessary for inventory, field recovery, storage, preparation, cataloging, and conservation of objects collected from BLM lands and stored with NPS museum collection.

1. Support may include storage cabinets, conservation supplies, maps, photographs, document folders and other cataloging materials.
2. Support may also include the staff assistance or contractual assistance in performing the tasks relating specifically to specimens collected from BLM lands.
3. Logistical assistance my include transportation and subsistence.

C. Permit NPS staff with authorization from the Superintendent to collect scientifically significant specimens. Activities involving collection of specimens will be contingent upon prior approval by BLM.

D. Agree to recognize the value to the scientific community of keeping the collection intact, however BLM may use other repositories.

Both Agencies agree to:

A. Share paleontological/geological research results.

B. Share graphic information data bases.

C. Ensure the timely consideration of applications for research permits potentially involving the land bases of both agencies.

D. Meet in the first quarter of each fiscal year to coordinate relevant activities.

Article III. Term of Agreement

This agreement shall be reviewed for modifications, termination, or renewal, at least every five years.

Nothing in this agreement will be construed as binding upon the Bureau of Land Management or National Park Service to perform beyond their respective authorities.

Article V. Termination

This agreement may be terminated by either party by providing 90 days written notice.

Article VI. Required Clauses

During the performance of this agreement, the participants agree to abide by the terms of Executive Order 11246 on nondiscrimination and will not discriminate against any person because of race, color, religion, sex, or national origin. The participants will take affirmative action to ensure the applicants are employed without regard to their race, color, religion, sex or national origin.

No member of delegate to Congress, or resident Commissioner, shall be admitted to any share or part of this agreement, or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this agreement if made with a corporation for its general benefit.

In witness whereof each party has caused this interagency agreement to be executed by an authorized official on the day of the year set forth by their signatures.
