INCIDENTS

97-255 - Fire Island NS (NY) - Follow-up on Search

The body of A.C., 49, was found by police divers shortly after noon
on June 9th.  A.C. went to the park on Saturday to work on his 28 foot
sailboat, which was moored at Barrett beach.  A.C. had donned SCUBA gear
and had gone diving near his boat.  He apparently drowned.  [CRO, FIIS, 6/10]

97-261 - Blue Ridge Parkway (NC/VA) - Marijuana Eradication
     
On June 9th, Plateau district ranger Richard Morefield was notified that a
DEA interagency task force had discovered a marijuana patch while flying over
park land in the Roanoke, Virginia, area.  A spotter helicopter guided
Morefield, ranger Charles Johnson, and four DEA agents to a total of three 
patches, all in areas of dense vegetation and rugged terrain.  It's unlikely
that any of the patches would have been detected from the ground.  A total of
75 plants ranging in size from one to four feet in height were removed and
destroyed by DEA agents.  The street value is estimated at $6,000.  There are
no suspects at this time.  The full extent of cultivation on park land is
unknown, and further flights are being planned.  [CRO, BLRI, 6/10]

CURRENT SITUATION

Several units in Arizona and New Mexico are reporting very high to extreme
fire dangers; others in Montana, Minnesota and Michigan are reporting high to
very high fire indices.  

A BLM reconnaissance plane crashed yesterday during a routine flight, killing
the pilot.

OPERATIONAL NOTES

Court Ruling on T-Shirt Sales - On June 6th, the United States Court of
Appeals for the District of Columbia Circuit upheld the constitutionality of
the National Park Service's sales regulation for the National Capital Region
in "Friends v. Kennedy."  This decision reverses a district court ruling
which held that the sales regulation violated the First Amendment as applied
to T-shirts.  The court of appeals ruled that the district court decision was
"palpably in conflict" with the court of appeal's ruling in "ISKCON v.
Kennedy" (1995), which upheld the constitutionality of the sales regulation
as applied to religious beads and audio tapes.  That regulation limits sales
on park lands to message-bearing books, newspapers, leaflets, pamphlets,
bumper stickers and buttons and sets standards for sales sites.  The decision
in "Friends" confirms the Service's right to effectively control sales
activities on the National Mall and elsewhere to prevent discordant
commercialism in federal parks.  It's not known whether they attorney's for
the "Friends" will appeal this decision.  [Dennis Burnett, RAD/WASO]
